§ 130.126. POSSESSION AND USE OF TOBACCO, VAPOR PRODUCTS OR ALTERNATIVE NICOTINE PRODUCTS.

  • (A) It shall be unlawful for any minor under the age of 18 years to smoke, use or have in that minor's possession, custody or control cigarettes, cigars, pipe tobacco, smokeless tobacco, tobacco in other forms, vapor products, or alternative nicotine products. What constitutes vapor products and alternative nicotine products shall be those as found in the definitions used in Neb. RS 28-1418.01.
    (B) Any person found to be in violation of this section, upon conviction thereof, shall be fined as follows:
    (1) First offense: $10 plus costs;
    (2) Second offense: $25 plus costs; and
    (3) Third and subsequent offenses: $50 plus costs.
